Welcome to Snaplates. The terms "we", "us" and "our" refer to Nutech Innovations Pty Ltd trading as Snaplates.

Snaplates operates this store and website, including the information, content, features, tools, products and services made available through it (the "Services"). Our online store is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service, together with any policies referenced in them, describe your rights and responsibilities when you use the Services.

Please read these Terms carefully. By visiting, interacting with or using our Services, you agree to these Terms of Service and our Privacy Policy. If you do not agree to these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other applicable law that cannot lawfully be excluded, restricted or modified.

1. Access and accounts

By using the Services, you represent that you are legally capable of entering into an agreement to use the Services or that you are using the Services with the consent of a parent or guardian where required.

You may be asked to provide information including your name, email address, billing, payment and shipping information. You agree that information you provide will be accurate, current and complete.

You are responsible for maintaining the security of your account credentials and for activity conducted through your account.

2. Our products

We make reasonable efforts to accurately describe and display our products. However, colours, brightness and product appearance may vary depending on your device, screen settings, vehicle, installation and environmental conditions.

Product descriptions, specifications, availability and designs may change from time to time.

We may discontinue products or limit quantities available for purchase.

Nothing in this section limits any rights you may have under the Australian Consumer Law.

3. Orders

When you place an order, you are making an offer to purchase from Snaplates. An order is accepted when we confirm acceptance and successfully process the applicable payment.

Please review your order carefully before submitting it. If you need to change or cancel an order, contact us as soon as possible at support@snaplates.com.au. We cannot guarantee that an order can be changed or cancelled once processing or dispatch has commenced.

If we cannot accept or fulfil an order, we will contact you using the details provided with your order and refund any applicable payment.

Returns and refunds are handled in accordance with our Return and Refund Policy and your rights under the Australian Consumer Law.

4. Prices and payment

All prices displayed to Australian consumers are in Australian dollars (AUD) and, where applicable, include GST.

Shipping charges and any optional charges applicable to your order will be displayed before you complete checkout.

Prices, discounts and promotions may change without notice. The price applicable to an order is the price displayed and agreed at the time the order is placed, subject to any rights or obligations arising from an obvious pricing error or applicable law.

You agree to provide accurate and authorised payment information when making a purchase.

5. Shipping and delivery

Snaplates ships from Perth, Western Australia, to addresses throughout Australia.

Shipping options, charges and estimated delivery times are displayed at checkout where applicable. Orders are generally dispatched within 1 business day.

Delivery timeframes are estimates and may be affected by circumstances outside our reasonable control.

If there is a problem with the delivery of your order, please contact us at support@snaplates.com.au.

Further information is available in our Shipping Policy.

Nothing in this section limits your rights under the Australian Consumer Law.

6. Intellectual property

Unless otherwise stated, the content of the Services, including the Snaplates name and branding, text, graphics, images, videos, product designs, website content and other materials, is owned by or licensed to Snaplates and is protected by applicable intellectual property laws.

You may use the Services for your personal, non-commercial use.

You must not reproduce, distribute, modify, republish, commercially exploit or otherwise use our content without our prior written permission, except where permitted by law.

Snaplates names, logos, product names, designs and branding must not be used without our prior written permission.

7. Optional tools

We may provide access to tools or services supplied by third parties.

Those tools may be subject to separate terms and conditions imposed by their providers. You should review those terms before using third-party tools.

To the extent permitted by law, we are not responsible for third-party tools or services that are outside our reasonable control.

8. Third-party links

Our Services may contain links to websites or services operated by third parties.

We do not control those third-party websites and are not responsible for their content, availability or practices.

Your use of third-party websites or services is subject to the terms and policies of those third parties.

9. Relationship with Shopify

Snaplates is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with Snaplates.

By using the Services, you acknowledge that Shopify is not the seller of Snaplates products and is not responsible for the fulfilment of purchases made directly from Snaplates.

Nothing in this section excludes any rights you may have against any party under applicable law.

10. Privacy

Personal information collected through the Services is handled in accordance with our Privacy Policy.

Because our online store is hosted by Shopify, Shopify and other service providers may process personal information in order to provide ecommerce, payment, fulfilment and related services.

Please review our Privacy Policy for further information about how personal information is collected, used and disclosed.

11. Feedback and reviews

If you provide feedback, suggestions, reviews, photographs or other content to Snaplates, you grant us permission to use that material for legitimate business purposes, including improving and promoting our products and Services, subject to applicable law.

You represent that you have the right to provide the material and that it does not infringe the rights of another person.

Where reviews or other endorsements are published, we may moderate content that is unlawful, misleading, offensive, fraudulent or otherwise inappropriate.

12. Errors and inaccuracies

Occasionally, information on our Services may contain typographical errors, inaccuracies or omissions relating to matters such as product descriptions, pricing, availability, promotions, shipping charges or delivery estimates.

We may correct errors or update information when identified.

Nothing in this section limits any rights or remedies available to you under applicable law.

13. Prohibited uses

You must not use the Services:

  • for an unlawful or fraudulent purpose;
  • to infringe our intellectual property rights or the rights of another person;
  • to transmit malicious software or interfere with the security or operation of the Services;
  • to collect personal information unlawfully;
  • to send spam or other unauthorised communications;
  • to impersonate another person or misrepresent your identity; or
  • in a way that could damage, disable or materially interfere with the Services.

We may restrict or terminate access where we reasonably believe these Terms have been breached.

14. Automated agents

Automated systems, bots or agents must not access or interact with the Services in a manner that circumvents security controls, access restrictions, CAPTCHAs or other technical measures intended to protect the Services.

We may restrict automated access where reasonably necessary to protect Snaplates, our customers or the operation and security of the Services.

15. Suspension and termination

We may suspend or terminate access to the Services where reasonably necessary, including where these Terms have been materially breached, fraudulent or unlawful activity is suspected, or the security or operation of the Services is threatened.

Termination does not affect rights or obligations that arose before termination or provisions that by their nature are intended to continue afterwards.

16. Consumer guarantees and warranties

Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.

You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.

Any warranty or other benefit provided by Snaplates is in addition to these rights and does not replace, restrict or exclude them.

17. Limitation of liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right, remedy or liability that cannot lawfully be excluded, restricted or modified, including rights under the Australian Consumer Law.

Subject to those rights and to the maximum extent permitted by law, Snaplates is not liable for indirect or consequential loss arising from circumstances outside our reasonable control.

Nothing in these Terms is intended to limit liability where doing so would be unlawful.

18. Indemnification

To the extent permitted by law, you are responsible for loss suffered by Snaplates as a direct result of your unlawful use of the Services, your material breach of these Terms, or your infringement of another person's rights.

This section does not require you to indemnify Snaplates for loss caused by our own negligence, breach of law or wrongful conduct.

19. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be severed or limited to the extent necessary, and the remaining provisions will continue to apply.

20. Waiver and entire agreement

A failure by us to exercise or enforce a right under these Terms does not constitute a waiver of that right.

These Terms and the policies referred to in them form the agreement governing your use of the Services, subject always to rights and obligations imposed by applicable law.

21. Assignment

You may not transfer your rights or obligations under these Terms without our consent where consent is reasonably required.

We may transfer our rights or obligations as part of a legitimate transfer, restructure or sale of our business, subject to applicable law.

22. Governing law

These Terms are governed by the laws of Western Australia, Australia.

You and Snaplates submit to the jurisdiction of the courts of Western Australia and applicable Commonwealth courts.

Nothing in this section limits any rights you may have under applicable consumer protection laws concerning jurisdiction or where proceedings may be brought.

23. Headings

24. Changes to these Terms

We may update these Terms from time to time.

The current version will be published on our website. Where required by law, we will provide appropriate notice of material changes.

Changes will not retrospectively remove or reduce rights that have already accrued to you.
